Use of Memorandum of Understanding (MOU) and Interdepartmental Letter of Agreement (ILA)

Effective immediately, all agreements with federal departments, agencies and Crown corporations, provincial, territorial, municipal governments and all agreements with public universities and colleges, are to put in place using an MOU or ILA and entered into myEMS as an earmarked fund. Alternatively, acquisition cards may be used up to your delegated authority limit of your card for the acquisition when accepted by such an entity, except for federal departments and agencies. CORCAN is the one exception where the card can be used with a federal organization.

This notice is done pursuant to Section 11.4.1 of the Treasury Board (TB) Contracting Policy which indicates that agreements between the federal government and the provincial/territorial and municipal governments are not contracts pursuant to the Government Contracts Regulations and the Contracting Policy; rather they are joint agreements.
