Claim damages caused by Phoenix : compensation for severe impacts

Employees who have taken leave because of health issues related to Phoenix or incurred severe damages and personal hardship due to Phoenix issues can file a claim under the Phoenix damages agreement.

A threshold of $1,500 applies with respect to some of these claims. This means that, for some types of claims, you will receive compensation if the total amount of damages is greater than $1,500. For claims where the threshold is applicable, it applies only once across all severe damages claims you make.

A threshold will be applied once your claim is assessed and resulting damages are calculated. If your claim does not meet the threshold, the calculation will be explained to you.

You can request compensation for severe impacts attributed to issues with the Phoenix pay system if you :

  1. are a current or former employee (indeterminate or term of more than three months) and you worked in an organization of the core public administration or a separate agency covered by the agreement between April 1, 2016 and March 31, 2020-if you are still employed in a department or separate agency covered by the agreement at the time your claim is processed, you will be considered a current employee.
  2. incurred damages between April 1, 2016 and March 31, 2020 as a result of Phoenix pay issues.
  3. are an unrepresented, executive or excluded employee; or a current employee, former employee and the estate of deceased employees represented by signatory bargaining agents under the 2019 damages agreement and similar agreements with separate agencies.

    Please note that claims and compensation processes will be available soon for eligible employees represented by the Public Service Alliance of Canada (PSAC) under the 2020 damages agreement and similar agreements with separate agencies.

    There are various types of claims you can make in this process. You can make one or several claims for severe impacts at the same time. Severe impacts could include:

    • financial costs or lost investment income due to delays in pay attributed to Phoenix
    • leave taken because of health issues related to Phoenix
    • severe damages and personal hardship due to Phoenix issues

    Before submitting a claim compensation for severe impacts:

    • Make sure you are eligible.
    • Familiarize yourself with the Agreement.
    • Familiarize yourself with the types of Claims.
    • Gather required documentation specific to each claim before starting your submission.
    • Only include information and documents that are relevant to your claim.

    Claims for compensation for severe impacts can be submitted two ways:

    • online through the TBS website
    • by mail, by completing the applicable claims form(s) (PDF)

    You may submit your claim by mail or courier. Registered mail or courier services are recommended as they provide confirmation your information arrived safely.

    Please make copies of your claim documents, as they will not be returned to you.

    Once a claim is authorized, the Claims Office will communicate with the employee to obtain a signed release form prior to the payment of the claim.
